These Terms of Service (“Terms”) are a legal agreement between you (“User,” “you,” or “your”) and Performance Insights Intelligence, LLC, a Texas limited liability company (“WLTR.AI,” “we,” “us,” or “our”), governing your access to and use of the WLTR.AI web application, services, and related content (collectively, the “Service”).

By creating an account, connecting your Stripe account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use WLTR.AI.

1. Eligibility

  • Be at least 18 years old.
  • Operate a legitimate business.
  • Have the legal right to connect your Stripe account and share data with WLTR.AI.

2. Account Creation and Security

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity under your account.

3. Data Access and Use

By using WLTR.AI, you grant us permission to:

  • Access your Stripe account data via secure API connections.
  • Store relevant information to provide insights and analytics.
  • Use anonymized, aggregated data for benchmarking, product development, and marketing purposes.

We do not sell personally identifiable information to third parties.

4. AI Insights Disclaimer

All insights, recommendations, and analytics provided by WLTR.AI are for informational purposes only. We do not provide legal, financial, or tax advice. You are solely responsible for any business decisions you make based on our insights.

5. Subscription and Billing

  • WLTR.AI is offered on a subscription basis (monthly, annual, or as otherwise stated at signup).
  • Payments are processed through Stripe.
  • Subscriptions automatically renew unless canceled before the next billing cycle.
  • No refunds are provided unless required by law.

6. Prohibited Activities

  • Use WLTR.AI for any unlawful purpose.
  • Attempt to reverse-engineer, copy, or resell the Service.
  • Interfere with security features or API connections.
  • Provide false or misleading information.

7. Intellectual Property

  • All WLTR.AI branding, software code, design elements, and content are owned by Performance Insights Intelligence, LLC.
  • You are granted a limited, non-exclusive, non-transferable license to use the Service for your own business purposes.

8. Service Availability

We aim to provide uninterrupted service but do not guarantee uptime. Service may be interrupted for maintenance, upgrades, or factors outside our control.

9. Limitation of Liability

To the fullest extent permitted by law:

  • WLTR.AI is not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim will not exceed the amount you paid in the last 12 months.

10. Termination

  • Fail to pay subscription fees.
  • Violate these Terms.
  • Abuse the Service or API.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

12. Changes to Terms

We may update these Terms at any time. Updates will be posted on our website, and continued use of the Service after changes means you accept the new Terms.
